Summer 2006 Facilities & Maintenance Update

THREE, BIG, NEW grounds maintenance equipment were on display on the lawn of the Educational Services Center (ESC) for the September 19, 2006 Board of Trustees Meeting. Carl Dunn, Coordinator of Facilities and Maintenance Operations, and Ray Ramsey, Manager of Custodial and Safety Services, presented the Board with an overview of custodial and maintenance work done during July and the first two weeks of August. This was the first summer since 1978 that custodians worked the month of July in the District. In his report, Dunn highlighted the remodeling done to move the technology department to the basement and the residency desk to the former tech office at the ESC, sewer and storm drain repairs at Monta Vista HS, major irrigation and field renovation at Lynbrook HS and asphalt repairs done at several high schools. The Board acknowledged Carl Dunn for the innovative ways he handles maintenance projects and repairs thus saving the District money. In his report, Ray Ramsey recognized the collaborative effort of the five School Facilities Supervisors in coordinating the deep cleaning projects at their high schools (Cesar DaSilva, Homestead HS and Leonard Perry, Cupertino HS could not attend the meeting). Homestead, Lynbrook, and Monta Vista High Schools had a crew of three custodians working during July stripping and waxing floors, shampooing carpets, removing cobwebs off ceilings, washing windows, dusting blinds, pressure washing exteriors, and washing whiteboards and shelves. The two other high schools received similar treatment in August as they had summer school classes in July. Monta Vista Principal April Scott reported that at their first staff meeting of the year, many employees said they noticed the rooms were different... noticeably “deep cleaned” and Ramsey also received emails thanking the custodial staff for this work. Acting Superintendent Polly Bove added that additional carpet cleaning machines have also been purchased for the sites to help better maintain the classrooms year round.

INTRODUCTION OF INDEPENDENT INVESTIGATOR
Neutral Investigator Barry Bennett from Law Offices of Bennett & Sharpe, Inc. was introduced as the firm chosen to conduct an “outside investigation” into why Monta Vista High School Teachers Melanie Walczak and Tim Krieger left the District. Bennett stated that he knew absolutely nothing about the case to be investigated but from the brief description given him, he felt confident that this was something his firm could handle. He stated that when his firm handles a case, particularly in the education field, their job is to determine how someone neutral would look at the issue and he confirmed that his firm is used to doing just that. Bennett stated that his firm could provide the Board with an update of their investigation at the October 3, 2006 Board meeting and at that time would have an idea of how long this investigation would take. The Board agreed that they would like this investigation to be handled in a timely manner but of utmost importance was that it was thorough and fair. Board Vice President Barbara Nunes read the motion from the August 22nd Board meeting that called for the investigation. Acting Superintendent Polly Bove stated that Colleen Medeiros put together a folder of documents pertinent to the investigation such as Board agendas and minutes for the July 11 and August 22 meetings, emails, job descriptions, and all news articles. Medeiros will gather other information as needed or requested for the investigation.
COMMUNICATIONS
Fremont Education Association (FEA) President Tom Avvakumovits announced that FEA will hold a Fremont Union High School District Board Candidates forum this Thursday, September 21st from 3:30-5:30pm in the Board Room at the ESC. He thanked candidates Kathryn Ho, Avie Katz, and Barbara Nunes for agreeing to attend.
STUDENT BOARD MEMBER REPORT
Student Board Member Peter Lu, Monta Vista High School senior, reported on school activities at all five high schools. Lu acknowledged Mr. Kenison, mathematics teacher at Fremont High School, who is featured this month in San Jose Magazine’s Educators of the Year. Lu also announced that IDC is interested in helping with the districtwide food policy and that IDC plans to have a website this year.
SUPERINTENDENT’S REPORT
Acting Superintendent’s Polly Bove announced that the Cupertino Tournament of Bands will be held October 14, 2006 and asked if the Board would purchase the Sweepstakes Trophy Award as done it the past. All agreed.

DISCUSSED LEGAL EXPENSES RELATING TO DISMISSAL OF SUPERINTENDENT
As requested by a community member and a Board member, the District reported legal expenses in connection with the dismissal of the superintendent ($5,332.68 from June 21 - July 20, 2006). Board Members Homer Tong and Kathryn Ho expressed an interest in regularly viewing all legal bills the District incurs. After some discussion on how often the legal bills should be reported to the Board, CBO Geoffrey Kiehl suggested he put together a report on all legal bills incurred last fiscal year for the Board to review. He also suggested reporting legal bills at each budget study session. Community member George Hamma stated, “It is my understanding that the Board has two employees, the Superintendent and a lawyer. In response to the discussion about reporting legal expenses, I believe it might be most useful if the Board-related legal expenses were stated separately from the District legal expenses, even though the same attorney may be involved in both functions.” The reporting of legal expenses is still under discussion by the Board and staff.

Acting Superintendent Polly Bove acknowledged that the Board approved in tonight’s personnel report the appointment of Bill Richter for first semester and Harry Bettencourt for second semester as principals of Cupertino High School. She stated that the District is very fortunate to have them fill this spot as the District conducts a comprehensive search this school year for the “right fit” for the next principal of Cupertino High. * Classified School Employees Association (CSEA) President Pam Coppel announced that CSEA will hold a Board Candidates Forum on Tuesday, October 17th at 4:30pm at the ESC. * FEA President Tom Avvakumovits reiterated that the overall expenses tied to the dismissal of the superintendent is still the biggest concern of teachers districtwide. Board Member Kathryn Ho asked if District insurance would cover these expenses. Bove stated that these legal bills are not covered by the JPA (Joint Powers Authority insurance program) and contractual issues are not covered. Kiehl reported that the cost of a liability suit might possibly be covered beyond the District’s self insured retention of $25,000.
